running2win.com and the running2win mobile application (the "Website and App") are operated by Athletic Performance Tools, LLC. ("APT"). APT takes the private nature of your personal information very seriously. This privacy policy describes how we collect, use and disclose the personal information of visitors and uses of the Website and App. This privacy policy applies only to information collected by APT through the Website and App. Please read this notice very carefully.

BY USING THE WEBSITE AND APP, YOU EXPRESSLY CONSENT TO THE PROCESSING OF YOUR PERSONAL INFORMATION ACCORDING TO THIS PRIVACY POLICY. YOUR PERSONAL INFORMATION MAY BE PROCESSED IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS OTHER COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY.

Garmin Connect

APT allows members to connect their account with Garmin for importing data. Due to the overwhelming size of data that is saved on the APT servers, the following rules will be enforced:

  1. Any abuse of Garmin Connect data by a member will result in the deleting of all Garmin data from the APT servers.
  2. Automatic disconnect from Garmin will occur if member has not logged into their APT account for 90 days
  3. Automatic Garmin Connect data will be deleted from APT if member has not logged into their APT account for 120 days
    note: anything done on the APT servers has NO effect on the member's original Garmin data on Garmin.com

Public Postings

One of the purposes of the Website and App is for Members to share information with other Users. You should assume that any information that you post will be made available to other visitors to the Website and App. We may provide you the ability to anonymously post certain comments, in which case we will not include your contact information (i.e., name, email address, or postal address) on the Website and App in connection with such comments. However, the information you choose to post publically may reveal, or allow others to identify, your nationality, ethnic origin, gender, age, and other aspects of your life. Publically posting any information on the Website or App, including any information deemed "sensitive" by applicable law, is entirely voluntary on your part.

APT allows you, as a member, to restrict the viewing of individual workouts as well as "locking down" your entire running log. Choosing one or both of these options will, in fact, restrict access to your running log to APT and its service providers, affiliates, vendors and business partners.

R-Mail

R-Mail is a "home-grown" internal message systems that is similar to email. Messages written in r-mail are kept private to the members that own these messages. Messages can be deleted and, at this time, are purged from the APT servers each week. In the future this policy may change so that deleted r-mail messages will be archived. APT and its service providers, affiliates, vendors and business partners may access your r-mail messages subject to the limitations provided in this privacy policy.

The Information We Collect

We require consent from a parent or guardian before we collect the personal information of children under 13 years of age. If you are the parent or guardian of a child under 13 years of age, please review our Terms of Use Policy located here: TermsOfUse. The Website and App will collect personal information about you to give you the best user experience possible. During the registration process you will be asked to input personal information to create an account such as name, and email address. Once account has been created, there are many other optional questions you can fill out. APT collects such information only insofar as is necessary or appropriate to fulfill the purpose of your interaction with the Website and App.

When you visit the Website or use the App, the Website and App may collect anonymous, aggregated data regarding your activities. This anonymous, aggregated data cannot be linked or otherwise used to identify you. We may share aggregated information that includes non-identifying information with third parties for industry analysis and demographic profiling and there will be no connection between you and the data. Users of the Website and App shall not be entitled to any compensation stemming from the use of such aggregated or non-identifying information.

Use and Disclosure of your Personal Information

APT will use the personal information you submit to us to provide you full access and functionality of the Website and App. Accordingly, personal information may be used for the following purposes: (i) to provide and improve our services, features and content; (ii) to administer your use of our services and accounts; (iii) to enable users to enjoy and easily navigate the Website and App; (iv) to better understand your needs and interests; (v) to fulfill requests you may make; (vi) to personalize your experience; (vii) to provide you with announcements, notifications related to your use of the Website and App and other communications such as electronic newsletters, promotional e-mails or similar messaging; (viii) to provide service announcements; (ix) to protect against users seeking to hack into the Website or the App; and (x) to assess the level of general interest in the Website and App and specific information included in the Website and App.

Except as provided elsewhere in this policy APT will not disclose your personal information to third parties outside of APT and its service providers, affiliates, vendors and business partners unless APT has the good faith belief that disclosure is reasonably necessary to:

  1. cooperate with law enforcement authorities or comply with legal process served on APT or the Website or App;
  2. protect the property and rights of APT, its affiliates or a third party;
  3. protect the safety of the public or any person;
  4. prevent or stop any activity we may consider to be, or to pose a risk of being, illegal, unethical, inappropriate or legally actionable;
  5. complete, as permitted by law, a business sale, asset transfer, merger, acquisition or reorganization; or
  6. fix or debug problems with the Website or App servers, software or service.

If APT discloses your personal information pursuant to one of the above-mentioned conditions, it will do so only to the extent necessary.

Security of your Personal Information

APT is committed to protecting your personal information. We regularly test our facilities and use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure.

Use of Cookies

As you use the Services, certain information may also be collected passively, including your Internet protocol (IP) address and the browser that you use to visit the Site. APT may also store a small text file called a "Cookie" on your computer to store your login information (if any) and your personal preferences for the Website and App. APT may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them). While you will not be able to use the Website and App if you disable Cookies in your browser. After you register and enable Cookies, we may associate this information with personal information that we have collected from you.

The Website may contain links to other web sites that are not owned or controlled by APT. The provision of such links is for your convenience and does not signify our endorsement of such web sites or location or its contents. We have no control over, do not review and are not responsible for t he privacy policies of or content displayed on such other web sites.

Privacy Policy Changes

We reserve the right to modify this privacy policy from time to time without notice. Please review this privacy policy each time you visit the Website and App so that you will be apprised of any changes. Your continued use of the App subsequent to any posted changes to this Policy means you accept those changes. We will provide notice to you if these changes are material and, where required by applicable law, we will obtain your consent.

Data Transfers

For users outside the United States, please note that any personally-identifiable information you enter into the Website and App will be transferred out of your country and into the United States. You consent to such transfer through your use of the Website and App. You also warrant that you have the right to transfer such information outside your country and into the United States.

Your California Privacy Rights

A business subject to California Civil Code section 1798.83 is required to disclose to its California customers, upon request, the identity of any third parties to whom the business has disclosed personal information within the previous calendar year, along with the type of personal information disclosed, for the third parties' direct marketing purposes.
